Suspire LLC partners with DHA/MOH licensed healthcare providers and labs in UAE & accredited labs in UK, USA, Germany, Korea to offer its services through its online portal; www.suspirelabs.com. Every laboratory investigation request from UAE should be prescribed by a UAE licensed physician and are performed at accredited labs only.
• Results of laboratory tests / clinical services done to obtain information about the health of a patient for diagnosis, treatment, and prevention of disease should be interpreted by a licensed medical practitioner.

1. LIMITED LICENSE

1.1.You are granted a limited, non-exclusive, revocable, and non-transferable license to utilize and access the site according to the requirements and restrictions of these Terms of Use.

1.2. Suspire LLC may change, suspend, or discontinue any aspect of the site at any time.

1.3. Suspire LLC may also, without notice or liability, impose limits on certain features and services or restrict your access to all or portions of the site.

1.4. You shall have no rights to the proprietary software and related documents and information if any, provided to you to access the site.

2. SITE OPERATION

2.1.  We operate from the United Arab Emirates.

2.2. All Suspire LLC services can be purchased or utilized in UAE or other locations at the user’s own risk and after a complete understanding of the proper use of the product.

2.3. While using this Site it is your responsibility for ensuring compliance with your local laws, and Suspire LLC doesn’t take responsibility for misuse or damages of any kind from the usage of the product and services on its Online Portal.

3. APPLICABLE LAW

The Laws of the United Arab Emirates shall govern the use of the Site and the Terms of Use, without regard to conflict of laws principles. All disputes arising in connection therewith shall be heard only by a court of competent jurisdiction in U.A.E.

4. MULTI-CURRENCY PRICED TRANSACTION

The displayed price and currency selected will be in UAE Dirhams, applicable exchange rates for other currency as per the bank will be applied as per the prevailing rates. The invoices  will be  printed in AED.

5. PURCHASES

5.1. Suspire LLC accepts payment by Visa or Mastercard, debit, and credit cards in AED for its products and services.

5.2. All online purchases are also governed by the terms and conditions of respective merchant service providers. Please review the respective merchant service provider’s user agreement and privacy policy before entering any transaction.

5.3. Multiple booking orders may result in multiple postings to the cardholder’s monthly statement.

5.4. Interpretation.

5.4.1. These Terms of Use supersede all other written and oral communications or agreements with regard to the subject matters discussed in these Terms of Use.

5.4.2. A waiver or modification of these Terms of Use will only be effective if made in writing signed by an authorized officer of Suspire LLC. All refunds will be made onto the original mode of payment.

6. OFFICE FOREIGN ASSETS CONTROL (OFAC) SANCTIONED COUNTRIES.

Suspire LLC will not trade with or provide any services to individuals and companies owned or controlled by, or acting for or on behalf of, OFAC targeted countries AND individuals, groups, and entities, such as terrorists and narcotics traffickers designated under the OFAC programs that are not country-specific.

7. REPRESENTATIONS BY YOU.

7.1. By visiting the Site, you represent, warrant and covenant that

14.6. The company shall not be responsible in case communication is not received by the customer regarding appointment schedules or reporting due to incomplete information provided by the individual.

14.7. Suspire LLC shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transactions done on the Site. Suspire LLC secures the rights to request for payments in such cases before proceeding with the utilization of the service.

14.8. Suspirelabs.com is only a platform for healthcare services provided by third-party service providers and is not in any case directly or indirectly responsible for the services provided by the third party.

14.9. Suspirelabs does not make representation or warranty any services, investigations or other medically related tests and services promoted by the third party.

14.10. Suspire LLC or its affiliates, or agents do not give any medical advice, including, but not limited to laboratory investigations or clinical services, and request you to consult your healthcare provider before utilizing its services.

Some jurisdictions do not allow exclusion of certain warranties or limitations of liability, so the above limitations or exclusions may not apply to you. The liability of Suspire LLC would in such case be limited to the greatest extent of liability permitted by law.

15. VIOLATION OF TERMS OF USE.

15.1. You understand and agree that in Suspire LLC’s sole discretion, and without prior notice, Suspire LLC may terminate your access to the Site, or exercise any other remedy available and remove any unauthorized user information, if Suspire LLC believes that the information you provide has violated or is inconsistent with these Terms of Use, or violates the rights of Suspire LLC, or any third party, or violates the law.

15.2. You agree that monetary damages may not provide a sufficient remedy to Suspire LLC for violations of these Terms of Use and you consent to injunctive or other equitable relief for such violations. Suspire LLC may release user information about you if required by law or subpoena.

17.4. Any communication or materials you send to Suspire LLC will be treated as non- confidential and non-proprietary and may be disseminated or used by Suspire LLC for any purpose, including, but not limited to, developing, creating, manufacturing or marketing products or services.

18. ADVERTISING.

The Site may contain advertisements and/or sponsorships. 20. OTHER TERMS AND CONDITIONS

20.1. Some tests and packages are conducted as a screening procedure only and are not to be taken as a medical advice by Suspire LLC or its affiliate members.

20.2. The health packages available on the Site cannot be split between two or more people and is non-transferrable, unless approved by Suspire LLC staff, in writing.

20.3. Some tests are centre dependant; tests and prices may vary from center to center.

20.4. Some tests may not be conducted if the person receiving the tests,reports with any contra indications medical or otherwise.

20.5. The soft copy of your medical reports, received from the service providers, will be made accessible to you electronically through online / email / etc reporting facility available on Suspirelabs.com.

20.6. Suspire LLC only facilitates the booking, testing and reporting of your medical investigation requirements and is not responsible for any Service Provider errors or malfunctions.

20.7. The soft copy of the medical reports will be emailed to you on the email ID available with Suspire LLC, unless requested otherwise.

20.8. Suspire LLC does not hold any liability or responsibility for any loss or damage that may be incurred to you, or your beneficiaries, as a result of presuming the meaning or contents of the report issued by the service provider.

  INVOICE TERMS AND CONDITIONS

SELLER’S ACCEPTANCE OF THIS ORDER IS EXPRESSLY CONDITIONED UPON BUYER’S ACCEPTANCE OF ALL TERMS AND CONDITIONS HEREOF AND ACCORDING TO THE DISCLAIMER PUBLISHED IN THE OFFICIAL WEBSITE (WWW.SUSPIRELABS.COM).

The terms and conditions hereof shall constitute the binding contract between Seller and Buyer concerning the goods sold hereunder. Neither party shall claim any amendment, modification, waiver, or release from any provisions hereof unless the same is in writing and signed by both Buyer and Seller.

2. Test Selection and Liability: The Buyer, in choosing and ordering tests, acknowledges doing so at their discretion. The tests/products are the responsibility of respective laboratories. Suspire L.L.C., as a facilitator, links Buyers with laboratories and does not assume ownership, representation, or interpretive authority over lab methodologies or results.
3. Role Acknowledgment: The Buyer understands that Suspire L.L.C.’s role is exclusively to coordinate the testing process between the Buyer and the laboratory. Consequently, the Buyer agrees not to hold Suspire L.L.C. accountable for any claims or issues arising from the test results, procedures, or outcomes, acknowledging Suspire L.L.C.’s role as a logistical intermediary, not as a provider or guarantor of the testing services.
4. Terms of Sale and Delivery:

• Prepayment and Order Fulfillment: Orders placed are subject to prepayment, unless specified otherwise in this agreement.
• Third-Party Delivery: We utilize third-party courier services for the delivery of goods. While we strive for timely delivery, please note that delays may occur due to circumstances beyond our control. In such instances, Suspire L.L.C. is not liable for any resultant damages or delays.
• Validity and Refund Policy for Test Analysis: We ensure the validity of any test ordered for a period of one months from the date of the invoice. Should this period elapse, the test will be deemed expired and automatically cancelled. It is important to note that post this validity period, no refunds will be issued for expired tests.

• Pre-Dispatch: If cancellation is requested before kit dispatch, refunds are subject to a 5% Bank/Credit Card processing fee of the invoice value.
• Post-Dispatch: After dispatch, refunds (if applicable) will incur a 5% processing fee and AED 200 for shipping. If the kit is not returned, an additional AED 200 per kit will be deducted.
• No Refund Post-Collection: No refunds will be issued for kits with samples already collected and sent for processing.
• Tampered Samples: Deliberate tampering with samples to hinder DNA extraction voids eligibility for a refund.

5. Cancellation Post-Kit Dispatch:

• Return Policy for Post-Dispatch Cancellations: In the event of a cancellation request after the dispatch of the kit, a deduction of AED 200 will be applied. Please note that the kit, once dispatched, is considered non-returnable and unusable for any subsequent purposes.
• Fee Deductions: Refunds apply only to DNA test analysis fees only, less a 5% processing fee and any applicable deductions. Please note, shipping charges are not refundable.

6. Cancellation Post-Sample Collection:

• Lab Rejection Policy: In cases where the laboratory rejects samples due to insufficient or poor-quality DNA, clients will be required to submit new samples. Additional kits and any necessary shipping for resubmission will incur a nominal fee. Please note that no refunds are applicable under these circumstances.

7. Restrictive Refund Policy:

• One-Month Limit: No refunds after one months of the invoice date.
• Repeat Collection Charge: Additional charges apply for repeat collections
